2. Services
We make various services available on this site including, but not limited to, air conditioning and heating filters, and other services. You are responsible for providing, at your own expense, all equipment necessary to use our services.
We reserve the sole right to either modify or discontinue the site, including any of the sites features, at any time with or without notice to you. We will not be liable to you or any third party should we exercise such right. Any new features that augment or enhance the then-current services on this site shall also be subject to these Terms of Use.
3. Registration Data and Privacy
In order to access some of the services on this site, you will be required to use an account and password that can be obtained by completing our online registration form, which requests certain information and data ("Registration Data"), and maintaining and updating your Registration Data as required. By registering, you agree that all information provided in the Registration Data is true and accurate and that you will maintain and update this information as required in order to keep it current, complete, and accurate.
You also grant us the right to disclose to third parties certain Registration Data about you. The information we obtain through your use of this site, including your Registration Data, is subject to our Privacy Policy, which is specifically incorporated by reference into these Terms of Use.

Your exponet.ca site account may be accessed only by use of your login name and password. You are solely responsible and liable for any use and misuse of your login name and password and for all activities that occur under your login name and password. For security reasons, you must keep your login name and password confidential and not disclose them to any person or permit any other person to use them, except an authorized Exponet representative. Exponet recommends that you choose a password that is unique to you and not easily guessed by others. You should change your password on a regular basis, and you must log out at the end of each session.
All login names and passwords remain the property of Exponet, and may be cancelled or suspended at any time by Exponet without any notice or liability to you or any other person. Exponet is not under any obligation to verify the actual identity or authority of the user of any login name or password.
You must immediately notify Exponet of any unauthorized use of your login name or password, or if you know or suspect that your login name or password has been lost or stolen, has become known to any other person, or has been otherwise compromised.
5. Use of Site and Conduct
You may not use the site for any illegal or unauthorized purpose. In addition to the laws of the Province of Ontario, Canada, you also agree to comply with all local laws that apply to your use of the site.
You may not use the site in any manner which could disable, overburden, damage, or impair the site, Exponetâs servers or computer network, or interfere with any other party's use and enjoyment of the site.
You agree that you are responsible for your own conduct and communications while using the site and for any consequences of that use. By way of example, and not as a limitation, you agree that when using the site, you will not:
- post or upload any inappropriate, promotional, defamatory, destructive, obscene, or unlawful content;
- defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
- post or upload any User Content that infringes any patent, trademark, copyright, trade secret or other intellectual property right of any party;
- impersonate another person, or falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of any content;
- use the site in connection with surveys, contests, junk email, spamming or any duplicative messages (commercial or otherwise);
- use any robot, spider, site search/retrieval application, or other device to retrieve or index any portion of the site to collect information about other users or domain names;
- upload files that contain bugs, viruses, trojan horses, worms, or any other similar software or programs that may damage the operation of the computer or property of another; or

This Agreement and its performance shall be governed by the laws of the Province of Ontario, Canada. You consent and submit to the exclusive jurisdiction of the courts located in the City of Mississauga, in the Province of Ontario, Canada, in all disputes arising out of or relating to the use of exponet.ca and these Terms of Use.
16. Entire Agreement
These Terms of Use, together with those incorporated or referred to herein, constitute the entire agreement between us relating to the subject matter hereof, and supersede any prior understandings or agreements (whether electronic, oral or written) regarding the subject matter, and may not be amended or modified except by Exponet as set forth above.

Additional terms and conditions apply to purchases of products and services. Additional terms and conditions may also apply to specific site functions available on exponet.ca.
18. Miscellaneous
You may not assign your rights and obligations under these Terms of Use to any party, and any purported attempt to do so will be null and void. We may freely assign our rights and obligations under these Terms of Use.
You agree not to sell, resell, reproduce, duplicate, copy or use for any commercial purposes any portion of this site, or use of or access to this site.
In addition to any excuse provided by applicable law, we shall be excused from liability for non-delivery or delay in delivery of products and services available through our site arising from any event beyond our reasonable control, whether or not foreseeable by either party, including but not limited to, labor disturbance, war, fire, accident, adverse weather, inability to secure transportation, governmental act or regulation, and other causes or events beyond our reasonable control, whether or not similar to those which are enumerated above.
If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
Any failure by us to enforce or exercise any provision of these Terms of Use or related rights shall not constitute a waiver of that right or provision.

Terms and Conditions of Sale
1. Sale and Purchase of Goods
Exponet ("Seller") hereby agrees to sell, and You ("Buyer") hereby agree to purchase, goods of the description and quantity described on the checkout window ("Checkout") and incorporated herein by this reference ("Goods") on the terms and conditions set forth in this Agreement.
2. Product Descriptions
Exponet and its affiliates do everything in their power to ensure that the information on the site is as accurate as possible. However, Exponet does not guarantee that the product descriptions or any other content on the site are accurate, complete, reliable, up to date, or exempt of errors. If a product proposed by Exponet does not comply with the description, your only recourse is to return it in its original state. Picture shown may vary from actual product.
3. Purchase Price
Buyer agrees to pay the Purchase Price of the Goods as posted on this website attached hereto.
The prices of our products are displayed in Canadian currency and the applicable taxes are added to the amount. All orders, regardless of their origin, are payable in Canadian currency. Seller retains the right to modify its prices at any time. Products are always billed on the basis of the amounts in effect at the time when the order is recorded.
4. Taxes
Seller calculates the taxes based upon the address where the order will be shipped. For an order shipped in Canada, the taxes depend upon the province.
5. Payment
The total amount of the Purchase Price and applicable taxes shall be payable in full by Buyer according to the payment at the time of Checkout.
The payment of your purchased goods must be completed through MasterCard or Visa. Exponet can modify the price after having advised the customer. The customer is the solely responsible of the actual payment of the purchased goods. Exponet is not responsible of payment problems related to operation of e-commerce service.
6. Risk of Lost Goods
All purchases completed on our site are done so in accordance with the shipping contract. This means that the risk of lost Goods and property rights associated with the Goods are transferred to the Buyer at the moment when we remit the item to the carrier.
7. Shipping
Shipping rates are calculated in accordance with the postal code the Buyer has provided, the weight of the Goods purchased and shipping method. The Buyer will be able to consult the charges prior to confirming your order.
Expected delivery dates vary depending upon the actual destination and the delivery method the Buyer has chosen. Please note, Buyer will receive a confirmation email once Exponet has your order ready. This email will include the item's tracking number so you can follow your product at any time on the carrierâs site.
We ship to most provinces in Canada (with exception to Yukon, Nunavut and Territories) and also to Contiguous USA.
- Free Shipping offer is valid only within designated cities and regions Canada and USA.
- Orders will be sent via Ground shipping method unless specified at the time of order.
- Free Shipping offer is valid on selected products only.
- Our everyday low shipping charges will be applied to any non-eligible products at the time of checkout.

- Most items will arrive in just 2-9 business days subject to availability.
- Return shipping costs and risks are the responsibility of the Buyer.
- Seller reserves the right to end or change this Free Shipping offer at any time.
8. Delivery
Unless otherwise agreed in writing, delivery shall be made in accordance with Seller's shipping policy in effect on the date of shipment. Delivery dates provided by Seller are estimates only. Seller will make reasonable efforts to deliver in accordance with such dates; however, Seller will not be liable for failure to deliver as estimated. Unless otherwise agreed in writing by Seller, Goods shall be packaged according to Seller's standards and practices.
All delivery charges and taxes will be added when applicable to the prices shown on our website. Duties and brokerage fees (if any) will be the sole responsibility of the Buyer, and may be collected by a third party.
9. Returns and Refunds
Buyer has up to thirty (30) days from its reception to return Goods for either a refund or an exchange. When you return Goods, you must include the invoice and a note that details the reason behind the return.
Each filter has a nominal size and an actual size where the actual size differs by brand. All our listings show both to ensure our buyers make an informed decision. Please let us know the exact size of your existing filter and we can help you find the correct filter.
You are welcome to return the product to us. Please do not ship the item back unless requested.
Incorrect items ordered â If you have ordered an incorrect item and wish to return it, we can help you save on your return costs by sending you a discounted shipping label.
Damaged items received â If you have received an item purchased from us which was damaged in transit, please contact us, so we can help you resolve this issue.
Incorrect items received â If you have received an incorrect item from us, please contact us before returning the product.
Returns are subject to a restocking fee as per our return policy. Restocking fee of 20% of item's price with a minimum of $20.00 will be charged on all returns where the product has been shipped as per order and no errors were made on shipment by the seller. Items must be returned by the buyer and received by the seller within 30 days from date of purchase. Certain products are only eligible for return, if unopened and unused.
Why do we charge restocking fee? The restocking fee only partially covers the cost of freight for the product shipped to the buyer at no charge.
The item returned shall be unused and in new and original condition in order to avoid additional charges. Up to 50% of item's price may be charged for items that are not in their original condition or damaged.
After the successful return of the previous product we will refund you the amount for your previous order, less restocking fee and if applicable cost of the return shipment.

Buyer must cover the shipping fees and the inherent risks for returned Goods. For Goods that are not defective, we do not accept returns wherein the Goods have been removed from the package.
In the case where an item is defective, it will be exchanged for a new copy of the same item. If Exponet has delivered the wrong Goods, Exponet will ship the correct one. In both cases, Exponet will cover the fees associated with the delivery and the risks as long as the return is completed via the authorized carrier.
10. Reimbursement
Upon reception of the returned Goods, the amounts that were debited from your credit card on our site with respect to these items, except for shipping fees, will be credited as soon as possible under the condition that the items that are subject to the return were done so by the Buyer and received by Exponet in the same condition as they were when they were shipped and received by the Buyer.
11. Order Cancellation
All orders are automatically processed on our secure merchant processor and sent for shipment as soon as they are placed. During this process we incur irreversible fees. Therefore, while we understand that orders might need to be changed sometimes, we are unable to do it free of charge after a certain point. We strictly adhere to the following cancellation policy:
If you cancel your order BEFORE it has been shipped, you will be assessed a 10% cancellation fee before credit is issued.
If you cancel your order AFTER it has been shipped, please follow our Returns and Refunds. The cancellation will have to be treated as a Return with all applicable fees.
Orders which are REFUSED AT DELIVERY will be assessed all of the applicable fees listed above - including restocking, cancellation and other applicable fees.
12. Limited Warranty
Seller supplies as its sole warranty the following:
- Manufacturerâs Warranty.
- The warranty shall last for as indicated by the Manufacturer of the Goods.
- The warranties provided for herein shall be governed by Seller's warranty policies in effect on the date of shipment.
13. Disclaimer of Warranty/Limitation of Liability
Seller undertakes no responsibility for the quality of the Goods or that the Goods will be fit for any particular purpose for which Buyer may be buying the Goods, except as otherwise provided in this Agreement, and Seller disclaims all other warranties and conditions, express or implied.
The seller (including its subsidiaries, affiliates, officers, directors, employees, agents, and subcontractors, collectively the âSeller Affiliatesâ) shall not be liable under any circumstance to the buyer or any other party for any special, consequential, incidental, or exemplary damages. This includes, without limitation, damages for lost profits, loss of goods or associated equipment, cost of capital, cost of substitute or replacement equipment, facilities or services, downtime, buyerâs time, loss of data, injury to property, or any damages or sums paid by the buyer to third parties, even if the seller or any Seller Affiliate has been advised of the possibility of such damages. The foregoing limitation of liability applies whether any claim is based on contract, warranty, negligence, other tort, breach of statutory duty, principles of indemnity or contribution, failure of any limited or exclusive remedy to achieve its essential purpose, or otherwise.
In no event shall the seller or any Seller Affiliate be liable to the buyer or any other party for any loss, damage, or injury of any kind or nature arising out of or in connection with these Terms and Conditions. In all cases, liability shall not exceed the net purchase price of the goods actually delivered to and paid for by the buyer.
The seller disclaims any warranties of non-infringement with respect to the goods. Neither the seller nor any Seller Affiliate shall have any duty to defend, indemnify, or hold harmless the buyer from and against any damages or costs arising from infringement of patents or trademarks, or violation of copyrights, by any of the goods.
14. Force Majeure
Seller shall not be held responsible for any failure of performance to make timely delivery of all or any part of the Goods in the event such failure was due, in whole or in part, to federal, provincial or municipal action, statute, ordinance or regulation, strike or other labor trouble, fire or other damage to or destruction of, in whole or in part, the Goods or the manufacturing facility for the Goods, the lack of or inability to obtain raw materials, labor, fuel, electrical power, water or supplies, or any other cause, act of God, contingency or circumstances not subject to the reasonable control of Seller, which causes delays or hinders the manufacture or delivery of Goods. Seller shall determine in good faith the extent to which it can reasonably control a cause, contingency, or circumstance that affects the performance of its obligations.
15. Miscellaneous
You may not assign these Terms or assign any rights or delegate any obligations under these Terms, in whole or in part, whether voluntarily or by operation of law, without our prior written consent.
Seller is the sole intended beneficiary of this Agreement.
If there is any inconsistency between this Agreement and any other agreement included with or relating to the Goods, this Agreement shall govern.
This Agreement may not be modified, altered or amended, except by the Seller. Any additional or altered terms attached to any order submitted by Buyer shall be null and void, unless expressly agreed to in writing by Seller.
If any term of this Agreement is illegal or unenforceable, the legality and enforceability of the remaining provisions shall not be affected or impaired.
This Agreement shall be interpreted under the laws of the Province of Ontario, Canada without giving effect to conflicts-of-law rules; and in the event of a dispute under this Agreement; Buyer submits to the exclusive jurisdiction and venue of the courts of the Province of Ontario, Canada and hereby waives any objection to such jurisdiction and venue.
